Post & Post LLC obtained a DEFENSE VERDICT in a wrongful death case on behalf of a surgeon and his physician group following a seven day jury trial in Montgomery County, Pennsylvania. Plaintiff’s decedent, a 62 year old female, had undergone a partial right colectomy. An endobag was utilized to collect and remove specimens during the surgery. Plaintiff’s counsel contended that the endobag, which had inadvertently been retained in the pelvis, caused peritonitis, intraabdominal sepsis, and ultimately led to the patient’s death. We maintained that the sterile endobag was not the cause of death, and that infection was a known risk of the procedure. We further contended that her death was a result of other complications which arose during her extended hospitalization. A defense verdict was returned.

A DEFENSE VERDICT was returned on behalf of our clients, a hospital and five pediatricians who were the 14 year old female’s primary care physicians following an 11 day jury trial in Delaware County, Pennsylvania. The case involved the alleged failure to diagnose bilateral ovarian torsion. As a result, the minor-plaintiff claimed she lost both ovaries and suffered premature menopause and loss of fertility. At trial, we successfully proved that appropriate and timely referrals to specialists were made, appropriate diagnostic tests were ordered, and the treatment complied with the standard of care in all respects. Ultimately, the jury found no negligence on the part of any of the defendants.

A DEFENSE VERDICT was returned following a 4 day wrongful death trial in Philadelphia County, Pennsylvania involving the alleged failure of a family physician and her practice group to recognize and treat signs and symptoms of a developing pulmonary embolism in a 78 year old patient who ultimately died. The jury found that the defendants were not negligent.

Following an 11 day jury trial in Delaware County, Pennsylvania, the jury returned a DEFENSE VERDICT for all defendants in this severe birth injury case. Our firm represented a major medical center and its nursing staff whose plaintiff alleged failure to properly monitor and respond to the fetus’ heart rate during labor and delivery, resulting in severe brain damage to the infant. The jury unanimously found for the defendant hospital as well as the other defendants.

Following a two week wrongful death trial in Delaware County, Pennsylvania, the jury returned a unanimous DEFENSE VERDICT in favor of our clients, a pulmonologist and his physician group. The case involved the death of a 22 year old female who presented symptoms of pulmonary embolism. Plaintiffs alleged that the pulmonologist and other health care providers failed to recognize the symptoms of an impending pulmonary embolism and thus failed to follow up and treat her life-threatening condition. The jury found no negligence on the part of our clients.

A unanimous DEFENSE VERDICT was returned in Bucks County, Pennsylvania following a seven day trial involving allegations of improper care during the labor and delivery of a child who suffered a shoulder dystocia (brachial plexus) injury. We represented the hospital and obstetrician involved in the delivery. The jury found no negligence on the part of the hospital staff or the obstetrician and awarded a defense verdict.

A DEFENSE VERDICT was returned in Philadelphia County, Pennsylvania in favor of our client, a hospital, following a six day trial. The case involved allegations of medical negligence in the administration of a purified protein derivative (PPD) injection to a pediatric patient, the foster child of plaintiff. The plaintiff contended that the hospital staff had negligently directed her to hold the child while the shot was given. The plaintiff claimed that the nurse inadvertently stuck the plaintiff instead, resulting in an adverse reaction to PPD. The jury found no negligence on the part of the hospital staff.

Post & Post LLC successfully defended a medical malpractice claim in Philadelphia County, Pennsylvania against our client, a treating physician, and the co-defendant nursing home. The claim arose from an alleged improper administration of medication and resulting overdose. Following a one week trial, the co-defendant nursing home was found liable, but our client physician’s care and treatment was determined not to be the cause of plaintiff’s injury and the verdict was solely against the nursing home.

Our firm successfully defended a major medical center criticized for failing to properly immobilize and treat a cervical spine injury in a 45 year old male plaintiff. A Delaware County, Pennsylvania jury returned a DEFENSE VERDICT following a seven day jury trial involving allegations that the plaintiff, a male maintenance worker, sustained a fall and resulting cervical spine injury that went undiagnosed and untreated, leading to quadriplegia.

Following a six day wrongful death trial in Philadelphia County, Pennsylvania, the jury returned a DEFENSE VERDICT in favor of our client, a primary care physician. The claim involved alleged failure to diagnose throat and lung cancer in a 59 year old male, a chronic smoker. The jury found no negligence.

A unanimous DEFENSE VERDICT was returned following a nine day jury trial in Lancaster County, Pennsylvania involving allegations of hospital malpractice in the care and treatment of a middle aged male who underwent a prostatectomy. Plaintiff accused the anesthesia team of extubating the plaintiff prematurely thereby causing him severe brain damage. We were successful in arguing that the anesthesia care was not the cause of the patient’s neurological difficulties. The jury unanimously found for all of the defendants.

A Delaware County, Pennsylvania jury returned a DEFENSE VERDICT following an eight day trial involving allegations against our clients, an obstetrician/gynecologist and the hospital staff. Defendants were criticized for allegedly improperly monitoring the mother-plaintiff who ultimately was found to have had a uterine rupture. The minor-plaintiff was profoundly impaired. A defense verdict was returned.
